In May 2024, Reuters reported that the US Justice Department was investigating Tesla for securities and wire fraud (US News & World Report). Whether criminal charges are brought by the Justice Department or other federal agency is immaterial. Any criminal charge under seal would only count upon the unsealing of the charge during the question's open period (Cornell - Charge, see Definition "1"). "Current or former executives" includes any person authorized to speak or act on behalf of Tesla, Inc. at the time the alleged crime occurred.
