In August 2024, Elon Musk renewed a complaint against OpenAI, Sam Altman, and others regarding OpenAI's moves away from being a nonprofit entity (MSN [Wall Street Journal], The Verge, Musk v. Altman, et al.). Whether the relief takes the form of a finding for damages, an injunction (preliminary or permanent), or a restraining order is immaterial (Cornell - Money Damages, Cornell - Injunctive Relief, Cornell - FRCP Rule 65). Whether relief is stayed pending appeal is immaterial, and the outcome of any appeals is immaterial. The question will close "No" upon the withdrawal of the complaint or dismissal of the case. In the event of a confidential or sealed settlement agreement, whether any relief was granted pursuant to a settlement entered or approved by the court will be determined using open-source reporting.
