Before 20 January 2026, will Donald Trump, JD Vance, or the incumbent of any cabinet position be found in contempt of court by a federal judge or judges for actions taken in an official capacity?
Closing Jan 20, 2026 08:01AM (in 9 months)
The Trump administration is facing a barrage of legal challenges to various executive orders and actions taken since his inauguration on 20 January 2025 (Brennan Center, Politico). A finding of either civil contempt or criminal contempt in pertinent proceedings will count, and the proceedings may be in any US federal court (Cornell - Contempt of Court). The positions considered cabinet positions are: Secretary of State, Secretary of the Treasury, Secretary of Defense, Attorney General, Secretary of the Interior, Secretary of Agriculture, Secretary of Commerce, Secretary of Labor, Secretary of Health and Human Services, Secretary of Housing and Urban Development, Secretary of Transportation, Secretary of Energy, Secretary of Education, Secretary of Veterans Affairs, Secretary of Homeland Security, Director of the Central Intelligence Agency, Director of the Office of Management and Budget, Administrator of the Small Business Administration, Ambassador to the United Nations, United States Trade Representative, Director of National Intelligence, and the Administrator of the Environmental Protection Agency. Whether the president adds or removes positions from the cabinet is immaterial, and the holding of an acting official will count (CATO).
